The son of a man from Fresno who died in August of 2019 After choking on a taco eating contest, sued the event organizers for negligence on Monday.

Marshall Hutchings , 18, alleges that her father, Dana Hutchings received no information about the risks posed by the contest , as reported by Fresno Bee.

The competition in which the man from 41 years took place during a Fresno Grizzlie game held on 13 August 2019. The participants had to devour as many tacos as possible in a given time .

After the deadly incident, the organization canceled the championship that would be held days later in Chukchansi Park.

Derek Frank, president of the Grizzlies, said to Los Angeles Times that neither he nor the Fresno Sports and Events company would rule on the lawsuit, which mentions them.

Martin Taleisnik, Hutchings lawyer argues that people who are professionally engaged in this type of contest have training and physical participation to which ” it doesn’t always happen in a amateur eating contest ”. Taleisnik insists that the organization should have warned his client’s father about what could happen and “take measures to protect them.”
