Judge Sidney Stein rejected the request for a new trial presented by the lawyers of former Senator Robert Menéndez who was found guilty of corruption.
Since July, the Democrat with Cuban roots was found guilty of 16 serious crimes, including bribery, fraud and acting as a foreign agent.
Despite this, His legal team intended to take advantage of an oversight by prosecutors that occurred while his trial was taking place.
During the presentation of evidence against the former chairman of the Senate Foreign Relations Committee, it was shown that, taking advantage of his political position, he secretly worked with the Egyptian government in exchange for luxurious gifts that included cash, gold bars, a Mercedes vehicle -Benz convertible and the payment of mortgages to three New Jersey businessmen, among other things.
However, his lawyers They claimed that he should be granted a new trial, because prosecutors inadvertently received information that they should not have considered.since they were incorrect versions of nine tests downloaded on a laptop, information that they later sent to the jury, which they maintained had an impact on their guilty verdict.
In this regard, Judge Stein refused to annul the former senator’s conviction, maintaining that throughout his trial he did not detect any irregularities.
“The jury’s guilty verdicts were easily supported by the extensive testimony of witnesses and the extensive documentary evidence admitted at trial, and there is no manifest injustice that requires a new trial”, wrote.
This way, Robert Menendez is scheduled to be sentenced next month with the possibility of going to several years in prison.
It should be noted that the legal situation of his wife Nadine Menéndez is still pending resolution, whose trial is suspended until she manages to overcome advanced breast cancer detected by the doctors at her service.
In fact, one of the legal resources that the former Democratic congressman tried to exploit was to hold his spouse responsible for having been the one who agreed and received all the bribes credited to her, a strategy that did not yield the expected fruit, since in the discharge of evidence corroborated his participation.
