A Nevada judge on Friday dismissed the case against six Republicans who submitted certificates falsely declaring Donald Trump as winner of the 2020 elections In this state.

Clark County District Court Judge Mary Kay Holthus ruled that the state chose the wrong jurisdiction to bring the case.

The judge’s ruling potentially overturns the casedetermining that state prosecutors chose the wrong place to file the lawsuit.

The judge canceled the trial which had been scheduled for January, for the 6 accused of trying to manipulate the result of the 2020 state election in favor of Donald Trump, which includes the chairman of the Nevada Republican Party and prominent leaders of the Las Vegas, Reno Republicans and Lake Tahoe.

They were each charged in December with offering a false instrument for presentation and making a forged instrument, felonies that carry penalties of up to four or five years in prison.

Nevada Attorney General Aaron Ford was in a Las Vegas courtroom after Clark County District Court Judge Mary Kay Holthus issued her ruling, and declared that he will take the case directly to the state Supreme Court.

“The judge was wrong and we will appeal immediately,” Ford told reporters, declining any further comment.

Trump supporters in Nevada and six other states that Joe Biden won in the 2020 election sent apparently official documents to Congress claiming that Trump was the true winner of the election.

The Republicans who were false voters in 2020 in four other states (Arizona, Georgia, Michigan and Wisconsin) face separate charges from local or state prosecutors. Their cases are not affected by Friday’s decision.

Republican false electors in the remaining states, Pennsylvania and New Mexico, were not charged. Unlike other states, the documentation they presented included a text which said his electoral votes should be counted only if Trump was determined to be the actual winner.
