Donald Trump appeals to the Supreme Court to resolve the case of his presidential immunity

Given this, Trump asked the judges to suspend the appeals court ruling that rejected his broad claim of presidential immunity andn connection with the events leading up to the assault on the Capitol on January 6, 2021.

Meanwhile, Trump’s lawyers made the request in which they wrote to the justices that they are preparing a petition for certiorari, or a full request for the high court to take up the case.

The Federal Circuit Court of Appeals for the District of Columbia issued a ruling against Trump on Tuesday, February 6, which it said would be implemented on February 12 unless the former president filed an emergency request with the Supreme Court.

Last week, three of the Court’s justices flatly rejected Trump’s attempt to obtain blanket immunity;

“Former President Trump has become a Trump citizen, with all the defenses of any other criminal defendant. We cannot accept that the office of the Presidency places its former occupants above the law forever. “It would collapse our system of separate powers by placing the President beyond the reach of all three branches,” the judges noted.

Under this context, if the court rejects Trump’s request, the case would return to US District Judge Tanya Chutkan, based in Washington DC, with the possibility of a trial taking place before the November elections and in In that sense, Chutkan has already backtracked on his original plan to hold the trial in March.

In December 2023, Chutkan rejected Trump’s request to dismiss the impeachment on presidential immunity and other constitutional grounds. The case is on hold while the appeal process plays out.

If Trump wins the election, he would be in a position to order the charges dismissed or seek a pardon.

Although Trump’s lawyers are asking the court to indefinitely delay the trial in federal court, who now They have the final say in determining whether the former president goes to trial in Washington before the November elections or not, it will be the Supreme Court.
