Garay was charged with murder by the Superior Court of the State of California, in Los Angeles County and, as of February 22, 2019, a state warrant for his arrest had been issued. A year later, on April 7, 2020, he was federally charged by the District of California.

After committing the murder the person responsible fled, so the US authorities took action to capture himpresuming that he was hiding in the state of Aguascalientes.

This is how the Federal Bureau of Investigation requested the collaboration of the authorities in that entity for his location and arrest. Once the criminal detected the presence of the police officers, he tried to flee without success.

After his arrest, he was referred to the federal authorities, who began the corresponding procedures for him to be extradited to the United States and answer for the murder of which he is accused.
