Biden stops federal prosecution for marijuana use, but maintains punishment for trafficking

Today President Joe Biden will announce a series of executive actions to address the country’s failed approach to marijuana, a senior White House official announced.

Biden will announce three steps:

The president is pardoning all prior federal crimes of simple possession of marijuana. This pardon also applies to all persons convicted of simple possession of marijuana under District of Columbia Law.

According to the White House there are thousands of people with prior federal marijuana possession convictions who may be denied housing, employment and educational opportunities and this item will help alleviate those collateral consequences, which is why the President has asked the Attorney General to develop an administrative process to issue Certificates of Pardons to eligible individuals.

Step two, the president urges all governors to do the same with Regarding the state crimes of simple possession of marijuana, so no one should be in a local jail or state prison for that reason either.

As a third step, the president has asked the Secretary of HHS, as well as the Attorney General that expeditiously review how marijuana is scheduled under federal law.

Federal law currently classifies marijuana and Schedule One of the Controlled Substances Act as the same schedule as heroin and LSD and even higher than the classification of fentanyl and methamphetamine.

Although federal and state laws change on marijuana, the president has made it clear that limitations on trafficking, marketing and sales to minors must be maintained.
