Who are the immigrants that ICE must deport “immediately”, according to the judge's order

The decision of Judge Michael Newman, who dispatches in Ohio, has raised questions about what should be the priorities of the Immigration and Customs Enforcement office (ICE ) for deportations.

If the immigration agency follows the decision of Judge Newman to the letter –appointed by the former president Donald Trump–, then he must apply the arrest and deportation of 1.2 million immigrants perfectly locatable and with processes ready.

However, according to experts, that is “impossible”, because the Department of Homeland Security (DHS), on which ICE depends, does not have sufficient resources to strictly apply Judge Newman’s order.

“The Ohio judge’s decision created a serious conflict, Jaime Barrón, a Texas immigration attorney told Univision. “We know that DHS cannot comply with the ruling, because it does not have the resources to do so.”

He added that the judge’s decision is a political issue, since he insisted that the DHS does not have the capacity to “deport all” immigrants without documents of legal stay in the US.

However, immigrant advocates have suggested that undocumented immigrants with deportation orders seek legal help, since the immigration agency could apply some of the cases on a discretionary basis, so that it is almost impossible to know who would be targeted.

Judge Newman’s decision is against the deportation guide promoted by Secretary Alejandro Mayorkas –and which came into force on 29 of last November–, in which ICE agents are asked to focus their efforts on people with a criminal record or who are a threat to national security.

Among other things, the Ohio judge prohibits immigration agents “from authorizing the release, whether on bond, supervision or otherwise, from a non-citizen with a final order of removal during the removal period.”
