Carruth attorneys claim self-defense , arguing that Read’s murder was a “justifiable murder.”

David M. Guinn, one of Carruth’s attorneys, said: “All Texans can legally brandish a firearm to protect themselves, their property, and their business.

“When Kyle did that, Chad Read advanced on him, and instantly, tried to take the gun away from him.

“In doing so, he was strong enough to throw Kyle 180 degrees around Kyle’s yard.

“Lifting his left leg, he continued his advance towards Kyle, threatening him and posing an immediate threat. Kyle replied.

“This is a justifiable homicide.”

Police have not pressed charges against Carruth for the Nov. 5 shooting, local media reported.

The attorney praised the handling of the case by the Lubbock Police Department.

“LPD knew they lacked probable cause and did not arrest him. Kyle cooperated with law enforcement.

“Our hopes are that a Lubbock grand jury will conduct a thorough investigation of all the facts and release the charges against Mr. Carruth. ”

He added that “everyone regrets the whole situation.

Read’s widow, Jennifer , filed a petition requesting custody of his children from his mother, Christina Read.
