William “Kyle” Carruth shot and killed to his wife’s ex-husband, Chad Read , in a incident captured in two videos recently published, after the police did not press charges against the shooter, pointing out “justifiable homicide” .
Carruth had an aggressive confrontation in front of her home in Lubbock, Texas, with Read, who claimed his ex-wife a matter related to the custody of their children.
In the videos, Read is seen arguing with His ex-wife, when Carruth demands that he leave, returns inside the house and immediately leaves carrying a gun.
The men face to face, while Read yells at him. Carruth to “use (the weapon), son of a p…, because damn it, I’ll take it from you and use it on you.”
Carruth steps back and fires a warning shot at the Read’s feet, who grabs the gun and grapples with Carruth, who backs off the porch and fires two shots, seemingly killing him instantly.
You can hear Jennifer Read, Chad’s widow and who posted one of the videos, “call 911 ”, while Carruth defends herself from the shots:“ I already told you, I told everyone to go away. ”
Two videos of the deadly shooting were posted, one from Read’s widow and one from Mr. Carruth’s attorneys.
Carruth attorneys claim self-defense , arguing that Read’s murder was a “justifiable murder.”
David M. Guinn, one of Carruth’s attorneys, said: “All Texans can legally brandish a firearm to protect themselves, their property, and their business.
“When Kyle did that, Chad Read advanced on him, and instantly, tried to take the gun away from him.
“In doing so, he was strong enough to throw Kyle 180 degrees around Kyle’s yard.
“Lifting his left leg, he continued his advance towards Kyle, threatening him and posing an immediate threat. Kyle replied.
“This is a justifiable homicide.”
Police have not pressed charges against Carruth for the Nov. 5 shooting, local media reported.
The attorney praised the handling of the case by the Lubbock Police Department.
“LPD knew they lacked probable cause and did not arrest him. Kyle cooperated with law enforcement.
“Our hopes are that a Lubbock grand jury will conduct a thorough investigation of all the facts and release the charges against Mr. Carruth. ”
He added that “everyone regrets the whole situation.
” Although Read He came unarmed, announced his intention to kill Kyle Carruth with his own weapon, and took immediate action to do so. ”
Read’s widow, Jennifer , filed a petition requesting custody of his children from his mother, Christina Read.
Several US states have laws that allow owners to use guns to defend themselves and their homes.
Attorney James Luster describes this doctrine as: “a man’s house is his castle.”
“Castle doctrine in Texas presumes that the use of the fu erza is reasonable and justified when another person forcibly and illegally enters or attempts to enter or forcibly remove you from your room, vehicle, or workplace. ”
Texas has “some of the laws strongest self-defense and property defense agencies in the country, ”he added.
