Donald Trump’s victory in the presidential elections and his warning to use the Department of Justice to invalidate all legal processes established against him, It led special prosecutor Jack Smith to decide to request a pause to analyze the case through which he intends to hold the Republican responsible for several crimes.
In November 2022, Attorney General Merrick Garland appointed Smith to take charge of Justice Department investigations involving Trump.
After gathering the relevant evidence, the legal expert accused Trump of several serious crimes such as conspiring to subvert the results of the 2020 election, mishandling classified documents and obstructing the government’s efforts to recover them from his property in Mar- a-Lago. However, at all times, the New York tycoon has pleaded not guilty.
In fact, before November 21, his legal team must present the relevant arguments in writing, setting out the basis for overturning the accusations against Trump in light of the Supreme Court’s ruling on presidential immunity.
However, the special prosecutor Jack Smith asked Judge Tanya Chutkan for a pause in the proceedings to determine how to move forward with the procedure to try to assign responsibilities to the now president-elect and this request was granted.
“As a result of the election held on November 5, 2024, the defendant is expected to be certified as president-elect on January 6, 2025 and take office on January 20, 2025. The Government respectfully requests that the Court rescind the remaining deadlines in the pre-trial schedule to allow the Government time to evaluate this unprecedented circumstance. and determine the appropriate course to follow in accordance with Department of Justice policy,” indicates a report sent by Smith’s team to the judge.
It should be noted that, before concluding his presidential campaign, Donald Trump warned Smith that he would fire him on his first day as president and apparently that has made the prosecutor nervous, who fought fiercely to send him to prison.
The special prosecutor promised that on December 2 he will present a report with the results of his deliberations.
