The social network TikTok is suing the US government due to the new law that seeks to force it to its parent company ByteDance, based in China, put it up for sale so that its new owner is a local businessman.

Through a recently filed court file, TikTok’s legal team argues that the US Congress is engaging in “unprecedented unconstitutional” action by stating and expressly prohibiting” the use of the application in its states unless it changes ownership.

In this regard, it is argued that a hypothetical sale of TikTok by ByteDance is not possible, which would “force a closure” of operations in the United States before January 19, 2025.

“For the first time in history, Congress has enacted a law subjecting a single named speech platform to a permanent nationwide ban and prohibits all Americans from participating in a unique online community with more than one billion people around the world,” says part of the text of the lawsuit filed by the company launched on September 7, 2016.
