The court that is trying the former Barça player Dani Alves for sexual assault determined this Monday that the Brazilian will be able to testify at the end of the trial which will be this Wednesday.
The Justice also rejected the allegations of violation of rights raised by his lawyer: “the accused was assisted by his defense from the first moment.”
Inés Guardiola, Dani Alves’ lawyer, took the opportunity to request the annulment of the case arguing that he was investigated behind his back and that the footballer has been subjected to a parallel trial.
An allegation that has been opposed by both the Prosecutor’s Office and the prosecution, who have highlighted that the damage from media exposure has been suffered by the victim, after Alves’s mother published on her Instagram profile not only the identity of the young woman but also videos of them.

The court has ruled out that the rights of the accused were violated during the investigation of the case because, a priori, it has not observed “any decisive anomaly” in the investigation.
Furthermore, he knows that “Alves was assisted by his defense from the first moment” while the sexual assault complaint “continued.”
He has also rejected that the accused has been defenseless due to the parallel trial denounced by his defense, which has provided the court with half a thousand pieces of information about the case.
The court agreed to the defense’s request that Alves testify at the end of the trial, after the witnesses and expert evidence. Although the alteration of the usual order of vision is a “controversial issue” In this case it is “fully justified” to guarantee that the accused responds to the interrogation “with full knowledge of all the evidence” conducted.
In this way, Dani Alves will testify in the last session of the trial, initially scheduled for next Wednesday afternoon, once the victim – who is being questioned today behind closed doors – and around thirty witnesses have appeared and before the parties present the reports with their definitive conclusions.
The court has also rejected the defense’s request that the victim’s statement – behind closed doors – be recorded with a distorted voice. and the pixelated image, considering that it is a measure that was adopted to combine the protection of the complainant with the right of defense, so it will also be protected by a screen so that there is no visual confrontation with Alves.
