Former President Donald Trump has appealed the partial gag order imposed on him by federal judge Tanya Chutkan, who is overseeing his subversion case in the 2020 federal election, after claiming she “took away my right to speak,” according to CNN.
“They are harassing us. And I have other evidence in which they are criticizing us. You saw yesterday where they took away my right to speak. I won’t be able to talk like I’m talking to you,” Trump told reporters Tuesday, moments before entering a New York courtroom to attend his ongoing civil fraud trial.
The notice of appeal against the partial gag order imposed on Trump was filed with Chutkan on Tuesday.
The gag order restricts Trump’s ability to publicly attack court staff, potential witnesses or special counsel Jack Smith and his staff.
Chutkan on Monday banned all parties involved in the case issue statements attacking special prosecutor Jack Smith, his staff, or any members of the court, including their families.
The order does not impose restrictions on derogatory comments about Washington DC or certain comments about the Department of Justice in general, although prosecutors requested them.
“It’s not about whether I like the language that Mr. Trump uses,” Chutkan said in court Monday in announcing the order. “This is language that presents a danger to the administration of justice.”
