Arkansas law banning transgender procedures for minors unconstitutional, says federal judge

Jay Moody, federal district judge declared unconstitutional an Arkansas law that prohibits transgender procedures for minors.

According to Moody’s opinion, the Arkansas law, the first of its kind in the country, violates the due process and equal protection rights of transgender youth and their families.

In addition, he noted that the First Amendment rights of health care providers are violated by prohibiting sending patients to other sites.

The judge’s ruling on the controversial law

“Instead of protecting children or safeguarding medical ethics, the evidence showed that prohibited medical care improves the mental health and well-being of patients and that, by prohibiting it, the State undermines the interests that it claims to promote”, highlighted the federal district judge.

In view of this opinion, the Republican Tim Griffin, state attorney general, expressed his “disappointment” with the ruling and announced that he will appeal to the Eighth Circuit.

“I am disappointed in the decision that prevents our state from protecting our children from dangerous medical experimentation under the moniker of ‘gender transition’”Griffin sentenced.

The Arkansas prosecutor indicated that there is no scientific evidence that any child benefits from such procedures.

“While the consequences are damaging and often permanent. I will continue to fight for as long as it takes to stop providers from sterilizing children.”he warned.

Arkansas Governor Supports Prosecutor’s Appeal

The governor of the state of Arkansas, Sarah Huckabee Sanders, also expressed her rejection of Judge Moody’s ruling.

“This is not ‘care’ – these are activists pushing a political agenda at the expense of our children and subjecting them to permanent and damaging procedures. Only in the vision of the awakening of the extreme left”, Sanders said on his Twitter account.

“We will fight this, and the Attorney General plans to appeal Judge Moody’s decision to the Eighth Circuit.”warned the governor.
