Colorado woman who ran unlicensed day care was sentenced in death of 3-month-old baby

A Widefield woman charged with child abuse, after a 3-month-old baby died in hospital after being unresponsive in his sleep in an adult bed in an unlicensed daycare, received this week his sentence of 10 days in prison and 4 years of probation.

In February of last year, the Widefield Police Department received an emergency call from a person requesting medical services because of an unresponsive baby. When the paramedics arrived at the home they found the woman giving CPR to the child.

The 3-month-old boy was rushed to the hospital where had a cardiac arrest and hours later was pronounced dead

. The forensic doctor’s report detailed that the death of the minor was due to an unsafe sleeping environment due to a face down position, which caused him to be unresponsive.

The records of the complaint report that Dana McNair was in charge of the baby and other children in her home that she used as a daycare center, but was not registered or licensed to practice that profession.

The defendant, aged 53, told the authorities that gave the baby his bottle, sucked the air out of him and then changed his diaper. Put the child to bed in an adult bed to take his nap, as described She put a rolled quilt behind his back to support him and covered him with a blanket.

McNair went to the kitchen to prepare lunch for the other children she was in charge of, according to KRDO. After 15 minutes he returned to the room to check on the child,

when he saw him had rolled over and was face down.

Dana McNair told officers during the interview that the boy was fine that he was healthy and always smiling and who had been taking care of him for a month. The police verified that the woman was taking care of 22 as children when the baby died and there was no other adult who could keep an eye on all the minors.

Dana McNair was accused of a charge of child abuse, that day he posted a bond of $50,000 dollars and walked free. In June she was detained by the authorities to begin her trial which was ruled before a judge this week.

Dana McNair was sobbing for the entire hearing with the judge and apologized to the family of the dead baby, confessed to feeling great pain for what happened. Some relatives of the children he cared for spoke in his defense because he always behaved well with them.

In addition to the sentence of 10 days behind bars and four years probation, McNair, you will have to take a course on empathy with victims, do 200 community service hours and writing a letter of apology to deliver to the District Attorney’s Office.
