The US will reimburse fees charged in error to certain migrants who applied for employment authorization

The Citizenship and Immigration Service (USCIS) reported that it mistakenly rejected some employment authorization applications from those applying for a U nonimmigrant visa , which were filed without a fee, or who requested an exemption between 14 June 2021 and until 29 September 1200 .

Therefore, it announced that in the coming months will refund the fees charged by mistake and will correct rejections also erroneous .

The called U Visa is for victims of certain crimes, physical and mental abuse , and grants aid to law enforcement agencies and government officials to bring the perpetrators to justice.

“USCIS also accepted fees in error when some petitioners for U nonimmigrant status unnecessarily submitted a fee with their Form I – 765. Currently, USCIS is monitoring this issue and is committed to correcting any errors and expects to issue refunds on or before 22 March 2022 ”, acknowledged the agency.

USCIS implemented a process of authenticity determinations so that certain principal petitioners of status do not U immigrant and eligible family members living in the U.S. receive employment authorization and deferred action. Under this policy there is no fee for an initial I – 1200.

From the 14 June of this year, USCIS allows people who live in the country with a determination of the authenticity of their petition for non-immigrant status, receive an employment authorization, a procedure that does not demand the payment of fees.
