Deported adult immigrants could face trial in the U.S. if they return

WASHINGTON – United States will prosecute single adult immigrants who have been deported after being detained at the border with Mexico and return to the country, warned this Friday the head of the Border Patrol’s operations direction, Manuel Padilla.

The official explained during a telephone press conference that Customs and Border Protection (CBP) began to apply this initiative “to reduce recidivism”, without specifying how long it has been in force.

He detailed that the measure will affect any single adult who has been apprehended at the border and deported under Title 8 of the United States Code, referring to “Foreigners and Nationality”.

Padilla stressed that these individuals will be referred “to a prosecution.”

In addition, it indicated that the Department Department of Homeland Security (DHS) “will continue to prosecute individuals under Title 42 ”.

That rule was issued during the term of former President Donald Trump (2017 – 2021) by the Centers for Disease Control and Prevention (CDC) -and extended by President Joe Biden- and allows the expulsion of the people who enter the country irregularly, in order to prevent the spread of the coronavirus pandemic.

Similarly, the official explained, families who recently arrived and cannot be evicted under that title 42 may face “expedited deportation”, in the event that they do not have a “ legal basis ”to stay in the country.

The deportation would be carried out under Title 8, which covers the Real Estate Law. Igration and Nationality.

Padilla indicated that accelerated deportation flights began last 30 July and so far, three have taken place to El Salvador, Guatemala and Honduras.

“We have returned dozens of families to their countries,” added Padilla, without specifying further details.

According to the data published in the past 16 July by CBP, authorities detained 188, 829 undocumented last June, which raised to 1, 80, 204 the number of arrivals in the current fiscal year, as of October 2020.
